JBO'S VIEW TERMS & CONDITIONS

These Terms & Conditions apply to all photography, videography, drone, business content, real estate, personal branding and other visual content services provided by JBO'S VIEW.

Individual quotations may contain specific terms relating to a particular project. Where a written quotation or agreement differs from these general Terms & Conditions, the specific written agreement will take precedence for that project.

JBO'S VIEW reserves the right to update these Terms & Conditions from time to time. The version applicable at the time of booking will apply to that project.

All quotations are based on the information provided by the client at the time of enquiry.

A quotation may include the agreed shooting time, number of photographs or videos, locations, deliverables, editing and other services.

A booking is considered confirmed once JBO'S VIEW has confirmed the booking in writing and the required deposit or payment has been received.

Dates and availability are not guaranteed until the booking has been confirmed.

If the scope of a project changes after a quotation has been accepted, JBO'S VIEW reserves the right to adjust the quotation accordingly.

Unless otherwise stated, all prices are exclusive of 21% IVA.

A standard booking requires a 50% deposit to secure the date, with the remaining balance due upon completion of the agreed services and before final delivery.

Alternative payment arrangements may be agreed in writing for specific projects.

Invoices are normally payable within 7 days, unless another payment term has been agreed.

Late payments may result in delayed delivery of the final content and may be subject to additional charges where applicable.

Because a booking reserves a specific date and time, cancellations and rescheduling may affect JBO'S VIEW's availability and preparation.

Unless otherwise agreed, clients are requested to provide at least 24 hours' notice for cancellations or rescheduling.

For cancellations made with less than 24 hours' notice, the deposit may be retained or cancellation costs may apply.

Where possible, JBO'S VIEW may offer the option to transfer the booking to another available date.

If a client does not attend the agreed session without prior notice, the booking may be treated as a cancellation.

Specific cancellation terms may be included in individual quotations for larger or more complex projects.

For outdoor photography, videography and drone services, weather conditions may affect the safety, quality or feasibility of a shoot.

JBO'S VIEW may recommend postponing or rescheduling a shoot when weather conditions are unsuitable.

For drone operations, flights are also subject to applicable regulations, safety requirements, airspace restrictions, weather conditions and any required permissions.

If a shoot must be postponed due to weather or circumstances outside the reasonable control of JBO'S VIEW, the parties will work together to arrange a suitable alternative date where possible.

The agreed quotation defines the scope of the project.

This may include shooting time, number of photographs, videos, reels, drone content, locations and other agreed deliverables.

Requests outside the agreed scope may result in additional charges.

This may include:

• additional shooting time;

• additional photographs;

• additional reels or videos;

• additional locations;

• extensive retouching;

• additional editing;

• additional equipment;

• drone services;

• or other services not included in the original quotation.

Additional services will be quoted or charged according to the applicable JBO'S VIEW price list or a separate agreement.

Unless otherwise agreed in writing, standard delivery times are:

Photography: within 3 working days after the shoot.

Initial video edit: within 5 working days after the shoot.

Final video edit: within 3 working days after receiving client feedback.

Larger or more complex projects may require additional delivery time.

Final photographs and videos will be delivered digitally in the agreed format and resolution.

Delivery times may also be affected by delayed client feedback, third-party services or circumstances outside the reasonable control of JBO'S VIEW.

JBO'S VIEW's services include the editing style and creative approach demonstrated in its portfolio and agreed as part of the project.

For video projects, one reasonable round of minor revisions is included unless otherwise stated in the quotation.

For photography, reasonable minor correction requests may be considered where appropriate.

Additional revisions, extensive retouching, major creative changes, changes to the original brief or requests for a completely different editing style may be charged separately.

A revision does not include creating an entirely new concept, reshooting content or producing additional photographs or videos.

RAW photographs, unedited video footage, D-Log footage, project files, editing files and other original working materials are not included in standard packages.

Only the agreed professionally edited final files are delivered.

If RAW files or source files are requested, this must be agreed in writing and may be subject to an additional fee.

JBO'S VIEW retains ownership of its original working files unless a separate written agreement states otherwise.

All photographs, videos and other original creative content produced by JBO'S VIEW remain the intellectual property and copyright of JBO'S VIEW unless a separate written agreement states otherwise.

Payment for a photography or video service does not automatically transfer copyright ownership to the client.

The client receives a licence to use the final delivered content for the purposes specifically agreed in the quotation or applicable licence.

Any transfer of copyright, exclusive rights or full buy-out must be agreed separately in writing.

The client's usage rights depend on the scope of the project and the licence agreed at the time of booking.

Unless otherwise specified, standard commercial usage may include the client's own:

• website;

• organic social media channels;

• business promotion;

• and other uses specifically agreed in the quotation.

Extended commercial usage may require an additional licence.

This may include, but is not limited to:

• paid advertising;

• large-scale advertising campaigns;

• billboards;

• packaging;

• publications;

• third-party platforms;

• resale of content;

• sublicensing;

• or other commercial applications outside the original agreement.

Usage rights may be limited by purpose, platform, territory, duration or exclusivity.

The client may not sell, sublicense, transfer or provide commissioned content to a third party for that third party's own commercial use without prior written permission from JBO'S VIEW.

For example, content may not be provided to another brand, company or organisation for its own independent advertising or commercial campaign without the appropriate usage rights.

This does not prevent the client from working with its own marketing agency, social media manager or other service provider to publish the content on the client's behalf, provided that the content remains within the agreed usage rights.

Unless otherwise agreed in writing, JBO'S VIEW reserves the right to use selected photographs and videos created during commissioned projects for its own:

• portfolio;

• website;

• social media;

• advertising;

• marketing;

• and promotional purposes.

This allows JBO'S VIEW to showcase completed work and promote its photography and video services.

If a client requires the project to remain private and does not want JBO'S VIEW to use the content for its own promotional purposes, this must be agreed before the project begins.

A Portfolio & Promotional Usage Exclusion Fee may apply.

The applicable fee will be communicated and agreed as part of the quotation.

Clients may request private or confidential treatment of commissioned content.

A client may also request extended, exclusive or full buy-out rights.

These rights are not included in standard packages and will be quoted separately.

The price for extended or exclusive rights may depend on:

• duration;

• territory;

• platforms;

• commercial use;

• exclusivity;

• number of images or videos;

• and the overall scope of the requested rights.

A full buy-out or copyright transfer is only valid when explicitly agreed in writing.

Unless otherwise agreed, the client is responsible for arranging and paying for models, talent, private locations, permits, styling, props and other third-party services required for the project.

The client is responsible for ensuring that the necessary permissions, releases and authorisations are available where required.

Where JBO'S VIEW arranges a model, location or third-party service on behalf of the client, associated costs will be included in the quotation or charged separately.

JBO'S VIEW is not responsible for permissions or restrictions that the client has failed to obtain or disclose before the project.

JBO'S VIEW recommends that clients download and securely store all delivered photographs and videos.

Project files, RAW files and other working materials may be retained for up to 4 weeks after final delivery.

After this period, JBO'S VIEW is not obligated to retain, restore or recover project files.

The client is responsible for maintaining its own backup of all delivered files.

Once final content has been delivered and accepted, JBO'S VIEW cannot guarantee the future availability of the files.

Clients are responsible for reviewing delivered content and providing feedback within a reasonable period.

For projects involving video editing or revisions, delays in receiving client feedback may affect the final delivery date.

Once final content has been approved and delivered, additional changes or re-editing requests may be charged separately.

JBO'S VIEW will take reasonable care when producing, editing and delivering commissioned work.

However, JBO'S VIEW cannot be held responsible for circumstances outside its reasonable control, including but not limited to:

• extreme weather;

• equipment failure;

• technical failures;

• venue restrictions;

• airspace restrictions;

• third-party failures;

• illness;

• travel disruption;

• or other unforeseen circumstances.

Where reasonably possible, JBO'S VIEW will work with the client to find an appropriate alternative solution.

JBO'S VIEW believes in:

• honesty;

• mutual respect;

• punctuality;

• clear communication;

• professionalism;

• and long-term client relationships.

Both parties are expected to communicate respectfully and professionally throughout the project.

JBO'S VIEW reserves the right to refuse or discontinue a project where serious misconduct, harassment, discrimination, unsafe working conditions or other inappropriate behaviour occurs.

By accepting a quotation, paying a deposit or proceeding with a commissioned project, the client confirms that they have read, understood and accepted these Terms & Conditions.
